Moving Beyond Ugly

The battle between PeopleSoft and Oracle is getting uglier. Now that they're in the discovery stage, PeopleSoft has been given permission to search a computer... that's on one of Larry Ellison's boats... that's currently anchored in the Mediterranean. In return, PeopleSoft has to give up some emails it had previously deemed "company secrets."

I think it's been a while since one of these hostile takeovers became so much like a particularly messy divorce, complete with a grumpy judge who already seems tired of the childish behavior of the litigants.

This isn't simply a case of two giant enterprise corporations having a silly day in court, it is about a tough minded third place competitor looking to seek and destroy the No.2 in the marketplace, a No.2 whose product is well respected by its customers, who has in Craig Conway, one of the best CEO's in the technology world and who has to fight off by all means possible a company whose vision of the future is to beat the big guys (Bill & Steve) at Microsoft. IMHO now they are turning their guns and massive cash reserves to try to blow a very good company called Peoplesoft out of the water. That's what the wrangling is about and Craig Conway has to fight fire with fire, this is not a case of legal kiddie school, for Peoplesoft, it is about survival. I don't fault Peoplesoft for paranoia, in this battle no stone should be left unturned and sometimes the very act of survival can make one do some strange little things especially when it is not a case of business as usual.
